Terms of use

DRAFT, NOT YET IN FORCE. This text is a placeholder that still needs legal review. It must be checked against the South African Consumer Protection Act, the ECT Act, EU consumer law and the Apple and Google store terms before it is published.

Last updated: 14 October 2026

These terms are an agreement between you and Finick (Pty) Ltd, South Africa ("we", "us"), for your use of the Earwise app and this website. By using the app, you accept these terms.

1. The service

Earwise provides audio guides for places of interest. Stories play automatically when you reach a stop. We may add, update or remove guides and features over time.

2. Purchases

Single guides and country passes are sold through the Apple App Store or Google Play, and their payment and refund rules apply. A purchase gives you a personal, non-transferable licence to use the content in the app for your own non-commercial use. Prices are shown in the store before you buy. EU consumers: when you download digital content straight away, you agree that it starts at once and you acknowledge that the 14-day withdrawal right then ends. This does not affect your statutory rights. [Wording to be reviewed.]

3. Stay safe and respect the rules

Always stay aware of your surroundings, traffic and the weather. Never use the app while driving. Follow the rules of each site, including opening hours, dress codes and areas that are closed to the public. Directions and stop locations are approximate. Opening hours, prices and access can change without notice.

4. Content

All guides, text, audio and design belong to us or our licensors. Do not copy, resell or redistribute them. Some photos are used under Creative Commons licences, as shown on our credits page. We work hard to be accurate, but the historical content is for general information.

5. Liability

To the extent the law allows, the app is provided "as is", and we are not liable for indirect or consequential loss arising from your use of it. Nothing in these terms limits rights you have under the South African Consumer Protection Act or other mandatory consumer law. [Liability cap to be confirmed.]

6. Privacy

Our privacy policy explains how we handle personal information.

7. Governing law

These terms are governed by the law of the Republic of South Africa. If you are a consumer in the EU, you keep the protection of the mandatory laws of your home country.
